BY VIRTUE OF AN ORDER of the Court of Common Pleas for Pickens County, South Carolina, heretofore issued in the case of Patricia Morgan and Elizabeth versus Neil Phillips, the undersigned as Special Referee, R. Murray Hughes, will sell on July 6, 2015 at 11:00 a.m. at the Pickens County Courthouse in Pickens, South Carolina, to the highest bidder:
All that certain piece, parcel or lot of land lying and being situate in the State of South Carolina, County of Pickens, about 5 miles North of Pickens, and containing a total of 0.92 of an acre, more or less, according to plat prepared by T. TERMS OF SALE: For cash. The purchaser(s) shall pay for deed and documentary recording fees and the successful bidder shall deposit with Special Referre for Pickens County a certified check or cash in the amount equal to 5% of the amount of the bid as evidence of good faith. Deficiency judgment being waived, the sale will not remain open and shall be final on the said sales day. In the event the successful bidder fails to comply with the terms of sale within 20 days the deposit will be applied to the cost and the balance distributed to the Plaintiff and the Special Referee shall forthwith resale the property, after due notice and advertisement, at such subsequent sales day until a purchaser who shall comply with the terms of sale is obtained. BY VIRTUE of a decree heretofore granted in the case of Branch Banking and Trust Company against Stephen R. Childress a/k/a Stephen Roy Childress, et al., I, the Special Referee for Pickens County, will sell on Monday, July 6, 2015, at 11:00 o’clock a.m., at the Pickens County Courthouse, Pickens, South Carolina, to the highest bidder:
All those certain pieces, parcels and lots of land situate, lying and being in the State of South Carolina, County of Pickens, known as Lots 17 and 18 on plat of Blanche Mauldin property made by J. A. Pickens and recorded in Book 1920, at Page 75, in the Register of Deeds Office for Pickens County, South Carolina, reference to said plat is being hereby made for a more complete metes and bounds description thereof.
This is the same property conveyed to James R. Childress and Shirley D. Childress by deed from J. Mack Childress dated May 25, 1973, and recorded May 29, 1973, in Book 12-R, at Page 318, records of Pickens County, South Carolina. Also, see Deed of Distribution from the Estate of James Roy Childress to Shirley Childress dated April 19, 2004 and recorded April 21, 2004 in Deed Book 809, at Page 24 in the Register of Deeds’ Office for Pickens County, South Carolina. Thereafter, the property was conveyed unto Stephen R. Childress a/k/a Steven Roy Childress by Deed of Distribution dated April 3, 2014 and recorded on April 3, 2014 in Deed Book 1594 at Page 277.

TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee for Pickens County at conclusion of the bidding, five percent (5%) of the bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of non-compliance. If the Plaintiff’s representative is not in attendance at the scheduled time of the sale, the sale shall be canceled and the property sold on some subsequent sales day after due advertisement. Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, the deposit shall be forfeited and the Special Referee for Pickens County may re-sell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder). As a deficiency judgment is being waived, the bidding will not remain open thirty days after the date of sale. Purchaser shall pay for preparation of deed, documentary stamps on the deed, and recording of the deed. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate of 5.50% per annum. The sale shall be subject to assessments, Pickens County taxes, easements, easements and restrictions of record, and other senior encumbrances.

Pursuant to Court Decree in Neal Lane Properties, LLC vs. Cass Casto and South Carolina Department of Revenue, I will sell at public auction to highest bidder at Pickens County Courthouse on August 03, 2015 at 11:00 a.m. o’clock the following property:

THIS BEING THE SAME PROPERTY conveyed to Cass Castro by deed from Neal Lane Properties, LLC by deed dated October 3, 2007, and recorded in the Register of Deeds Office for Pickens County on October 9, 2007 in Book 1140 at Page 43.

The successful bidder must pay interim interest from the date of sale through date of compliance at a rate of 10.00%.
Each successful bidder other than Plaintiff at time bid is accepted will be required to deposit with Special Referee as evidence of good faith 5% if bid in cash or certified check at the time of bid. In event purchaser fails or refuses to comply with terms of sale within 20 days from close of bidding, deposit shall be forfeited and applied to costs and then Plaintiff’s debt, and the Special Referee shall forthwith re-advertise and resell said property upon the same terms on some subsequent sales day at the risk of the former purchaser until obtaining full compliance with sale.
Bidding will close on sales day.
