BY VIRTUE of a decree heretofore granted in the case of: AgSouth Farm Credit, ACA v. Zeta Alyana Gardner, et al., Civil Action Number 2015-CP-39-01353, I, the undersigned Special Referee for Pickens County, will sell on Monday, June 6, 2016, at 11:00 o’clock a.m., at the Pickens County Courthouse, 214 E. Main Street, Pickens, South Carolina to the highest bidder:

All that certain piece, parcel or lot of land lying and being situate in the State of South Carolina, County of Pickens, about seven miles Northeast of the Town of Pickens, on the South side of S.C. Road 109, (Connelly Road), and according to a plat of C.E. Shehan, Surveyor, dated May 24, 1982, of plat of John D. Smith, and containing 10 acres, more or less, reference to which is hereby made for a more complete and accurate description.

Beginning at a railroad spike in center of road at northwestern corner, and running thence along center of road N73-4E 700 feet to a point; thence continuing along center of road N66-3E 26.37 feet to a railroad spike; thence leaving center of road and running along property of Wilson and Kay Browning S20-58E 540.15 feet to a concrete monument; thence along property now or formerly of Medlin-Williams Estate S63-37W 737.5 feet to an iron pin’ thence N20-08W 657.7 feet to a railroad spike in center of road, the point of Beginning.

This being the same property conveyed to Vivian H. Debnam and Christopher J. Debnam by deed dated June 3, 2008, and recorded June 5, 2008, in Book 1189 at Page 204, Pickens County Records.

TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee, at conclusion of the Bidding, five percent (5%) of his bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of non-compliance. Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may re-sell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder). Purchaser to pay for documentary stamps on the Special Referee’s Deed. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate set forth in the Note. Deficiency having been waived, the sale shall be final as of the date of sale. Further, you will please take notice that if no representative of the Plaintiff is present at the sale, said sale shall be rescheduled for the next available sale date. THIS PROPERTY IS BEING SOLD ON AN “AS-IS, WHERE-IS” BASIS WITHOUT REPRESENTATION OR WARRANTY AS TO ANY MATTERS OF TITLE OR OTHERWISE. A COMPLETE AND THOROUGH TITLE EXAMINATION IS RECOMMENDED PRIOR TO BIDDING ON THIS PROPERTY. YOU WILL PLEASE TAKE NOTICE that pursuant to an Order of the Honorable Kenneth D. Acker, Special Referee for Pickens County, issued in the above captioned case, the Special Referee will sell at public auction to the highest bidder for cash at or before the Courthouse in Pickens, South Carolina, at 11:00 o’clock a.m., Sales Day in June, the same being June 6, 2016, the following described tract of land located in Pickens County, South Carolina:

The terms shall be for cash and the purchaser, or purchasers, shall pay for the deed and stamps. In the event the agent of Plaintiffs do not appear at the time of sale, the within property shall be automatically withdrawn from sale and sold at the next available sales date upon the same terms and conditions as set forth in this Decree. Deficiency judgment having been waived, the bidding will not remain open after the date of sale, but compliance with the bid may be made immediately. The successful bidder shall deposit with the Special Referee a certified check or cash in the amount of five (5%) percent of the bid as evidence of good faith. In the event the purchaser fails or refuses to comply with the terms of the sale within twenty (20) days from the date of sale, the deposit shall be forfeited and applied first to the costs and expenses of this action including fee for the Plaintiff’s attorney. Next, any surplus will be held pending further Order of the Court. I shall then re-advertise and re-sell the property upon the same terms on a subsequent Sales Day at the risk of the former purchaser until obtaining full compliance with a sale.

Interest shall accrue on the amount of the bid from date of sale until date of compliance at the rate of $19.88 per day.

The sale shall be subject to taxes and assessments, to existing easements and restrictions, and to any other senior encumbrances.

A personal deficiency judgment being waived, bidding will not remain open. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate of 8.75% per annum.

Should the Plaintiff, Plaintiff’s attorney or agent fail to appear on sales day, the property shall not be sold, but shall be re-advertised and sold at some convenient sales day thereafter when the Plaintiff, Plaintiff’s attorney or agent is present.

Plaintiff does not warrant its title search to purchasers at foreclosure sale or other third parties, who should have their own title search performed on the subject property. Purchaser is responsible for the preparation and filing of their deed.
