SPECIAL REFEREE’S SALE

CASE NO. 2018-CP-39-00860

BY VIRTUE of a decree heretofore granted in the case of Branch Banking and Trust Company against Charles H. Nichols and Ann S. Nichols, I, the Special Referee for Pickens County, will sell on Monday, January 7, 2019, at 11:00 o’clock a.m., at the Pickens County Courthouse, Pickens, South Carolina, to the highest bidder:

All those certain pieces, parcels or lots of land, lying and being situate in the County of Pickens, State of South Carolina, designated as Tract A, containing 1.19 acres and Tract B, containing 1.26 acres as shown on a plat prepared for Charles H. TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee for Pickens County at conclusion of the bidding, five percent (5%) of the bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of non-compliance. If the Plaintiff’s representative is not in attendance at the scheduled time of the sale, the sale shall be canceled and the property sold on some subsequent sales day after due advertisement. Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, the deposit shall be forfeited and the Special Referee for Pickens County may re-sell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder). As a deficiency judgment is being waived, the bidding will not remain open thirty days after the date of sale. Purchaser shall pay for preparation of deed, documentary stamps on the deed, and recording of the deed. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate of 7.65% per annum. The sale shall be subject to assessments, Pickens County taxes, easements, easements and restrictions of record, and other senior encumbrances.

NOTICE OF PROPOSED

REISSUANCE OF A NATIONAL

POLLUTANT DISCHARGE ELIMINATION SYSTEM PERMIT

The following applicant has reapplied for a National Pollutant Discharge Elimination System (NPDES) permit to discharge treated wastewater into waters of the State of South Carolina. The NPDES permit contains effluent limitations on the amounts of pollutants allowed to be discharged, based upon preliminary staff review and application of the Federal Clean Water Act, the SC Pollution Control Act, and other lawful standards and appropriate regulations. The pollutant limitations and other permit conditions are tentative and open to comment from the public.

APPLICANT: CLEMSON UNIVERSITY WWTF, FACILITY NAME: CLEMSON UNIVERSITY WWTF (PICKENS COUNTY/GREENVILLE EQC OFFICE), NPDES permit #SC0034843, PO BOX 345801, CLEMSON, SC 29634-5801. The facility is located on Old Stadium Road and Madren Center Road at Clemson University, Pickens County. The facility has 1 discharge point: 001-treated sanitary wastewater, discharging to: Lake Hartwell; The Standard Industrial Classification (SIC) Code for the facility is 8221. The receiving streams are classified Class FW: freshwaters suitable for primary and secondary contact recreation and as a source for drinking water supply after conventional treatment in accordance with the requirements of the Department. Suitable for fishing and the survival and propagation of a balanced indigenous aquatic community of fauna and flora. Suitable also for industrial and agricultural uses. Sludge solids will be transported to the Palmetto Landfill & Recycling Center #422401-1101 (formerly DWP-092) and/or Anderson Regional Landfill #042651-1101 (formerly 041001-1102 & DWP-046) under conditions outlined in the NPDES permit. A fact sheet is available. This Permit when issued will supersede an existing permit which will expire on February 28, 2019.

Persons wishing to comment on or object to permit issuance or to the proposed permit limitations and conditions are invited to submit same in writing within thirty (30) days of the date of this notice to the attention of: Weijia Hu; SC DHEC; Bureau of Water; 2600 Bull Street, Columbia, South Carolina 29201; Telephone: 803-898-4256. The permit number should be placed at the top of the first page of comments. When there is a significant degree of public interest in a permit or group of permits, the Department may hold a public hearing. SC DHEC is not involved in zoning, land use, or property value issues. Please contact your local County or Municipal officials for questions or concerns on these issues.

All comments received within the 30-day period will be considered in the formulation of final determinations regarding the permit. All persons submitting written comments will be notified of the final determinations. Requests for adjudicatory hearings may be filed after the above described determinations have been made.
