BY VIRTUE OF AN ORDER of the Court of Common Pleas for Pickens County, South Carolina, heretofore issued in the case of Nell R. Ball vs. Toney A. Freeman, the undersigned as Special Referee, Kenneth R. Acker, will sell on January 5, 2015, at 11:00 a.m. at the Pickens County Courthouse in Pickens, South Carolina, to the highest bidder:
“ALL that certain piece, parcel or lot of land lying, situate and being in the State of South Carolina, County of Pickens, and being known and designated as 3.22 acres, more or less, as shown on a plat entitled “Survey For Lewis H. Rose and Jeraldine H. Rose” prepared by Robert R. Spearman, Surveyor, dated 12/21/95, and having such courses, distances, metes and bounds as will be shown by reference to said plat recorded in the Office of the Register of Deeds for Pickens County in Plat Book 213 at Page 4A.”
This being the identical property conveyed unto Toney A. Freeman by deed of Nell R. Ball dated February 3, 2014, and recorded February 5, 2014, in Deed Book 1581 at page 147, Pickens County records.

TERMS OF SALE: For cash. The purchaser(s) shall pay for deed and documentary recording fees and the successful bidder shall deposit with Clerk of Court for Pickens County a certified check or cash in the amount equal to 5% of the amount of the bid as evidence of good faith. Deficiency judgment being waived; the bidding will not remain open and will be final on sale day; however, sold subject to the 120 day right of redemption of the Internal Revenue Service pursuant to Internal Revenue Service Income Tax Lien filed by the Defendant, United States of America, Internal Revenue Service, against Toney A. Freeman, in the sum of $4,049.24 filed in the Office of the Register of Deeds for Pickens County, South Carolina, on March 13, 1992, in Lien Book 92, file 398. In the event the successful bidder fails to comply with the terms of sale within 20 days the deposit will be applied to the cost and the balance distributed to the estate and the Clerk of court shall forthwith resale the property, after due notice and advertisement, at such subsequent sales day until a purchaser who shall comply with the terms of sale is obtained. The subsequent sale or sales shall be made at the risk of the former purchaser.

SUBJECT TO PICKENS COUNTY TAXES
TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Special Referee at conclusion of the bidding, five (5%) of his bid, in cash or equivalent, as evidence of good faith, the same to be applied to purchase price in case of compliance, but to be forfeited and applied first to costs and then to Plaintiff’s debt in the case of noncompliance. Should the last and highest bidder fail or refuse to make the required deposit at the time of the bid or comply with the other terms or the bid within twenty (20) days, then the Special Referee may resell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the former highest bidder). No personal or deficiency judgment being demanded, the bidding will not remain open after the date of sale, but compliance with the bid may be made immediately.
The successful bidder will be required to pay interest on the amount of the bid from the date of sale to date of compliance with the bid at the rate of 6.99% per annum.

NOTICE IS HEREBY GIVEN that an action has been commenced and is now pending before this Court upon Complaint of the above named Plaintiff against the above named Defendant for foreclosure of the following described mortgage:
1. Mortgage from Paul E. Beck and Doris Beck to Pickens Savings and Loan Association, F.A. dated 11-17-2003 and recorded 11-25-2003 in the Office of the Register of Deeds for Pickens County, South Carolina in Mortgage Book 2496 at Page 1 in the original principal sum of $50,000.00;
The real estate which is the subject of this action is described as follows:
“ALL that certain piece, parcel or lot of land lying, situate and being in the State of South Carolina, County of Pickens, containing 0.60 acres, more or less, according to a survey prepared by Robert R. Spearman, Surveyor, dated November 23, 1992, and having such courses, distances, metes and bounds as will be shown by reference to said plat recorded in the Office of the Register of Deeds for Pickens County in Plat Book 44 at Page 654.”
This is a portion of the property conveyed unto Paul S. Beck and Doris S. Beck joint tenants with rights of survivorship by deed of J. W. Smith dated July 11, 1974, and recorded in Deed Book 12-V at page 333, Pickens County records. Paul S. Beck departed this life December 23, 2010 leaving Doris S. Beck as surviving joint tenant. Doris S. Beck departed this life March 28, 2013, see Pickens County Probate Court Case #2013-ES-39-436.

Upon reading the attached Affidavit, it appears to my satisfaction that this is a proper case in which service may be had upon Defendants by publication as authorized by 15-9-730 and 15-9-720 of the Code of Laws of South Carolina (1976).
IT IS THEREFORE ORDERED, that the Lis Pendens, Summons and Notice and Service by Publication shall be published in Pickens County Courier, a newspaper having general circulation in the County of Pickens, South Carolina, once a week, on the same day of each week, for a period of three consecutive weeks, said publication being hereby designated as the one most likely to give notice to said Defendants.
