NOTICE OF SALE
BY VIRTUE OF A DECREE of the Court of Common Pleas for Pickens County in the case of United Community Bank v. Otis Hopkins, et al. under Case No. 2019-CP-39-00139, I, the undersigned, as Special Referee for Pickens County, will offer for sale at public outcry at 11:00 A.M., on Monday, July 1, 2019, at the Pickens County Courthouse, 214 E. Main Street, Pickens, South Carolina, the following described real property, to-wit:
All that certain piece, parcel or tract of land situate, lying and being in the State of South Carolina, County of Pickens, about four (4) miles Southeast of the Town of Pickens, being bounded on the Northeast by land of Freeman, on the Northwest by land of Chapman, on the South by land of Blair and on the West by land of Crow, said tract herein conveyed containing five and two tenths (5.2) acres, more or less according to plat of T. Craig Keith, surveyor, dated July 28, 1965, according to said plat having courses and distances as follows, to-wit:
“Beginning at the East corner thereof at point near branch, running thence North 55 West 145 feet; thence North 67 West 227.5 feet; thence South 63-45 West 628 feet; thence South 6-35 East 324 feet; thence North 63-45 East 941 feet to the beginning corner.”
ALSO: “The Grantors convey unto the Grantees, their heirs and assigns, an easement for ingress, regress and egress, running from the public road to the lot herein above conveyed across adjoining lands of the grantors. Said easement to be twelve (12) feet in width over and along the strip of land running from the public road to the South line of the land herein conveyed along a course located as shown on said plat as follows: Beginning at a point on the paved road as shown on plat, running thence South 81 West 95 feet; thence North 25 West 72.2 feet; thence North 58-30 West 613 feet. The 12 foot strip is to be used as a roadway in common by the Grantee, their heirs and assigns and by the grantor, their heirs and assigns.”
This is the same property conveyed to Hazel M. Hopkins by deed from James D. Garrett and William R. Garrett and Tony R. Garrett and Susan G. Garrett dated 12/17/02, and recorded 12/19/02, in Book 711, at page 211, records of Pickens County, South Carolina.
The above described property is subject to any and all easements and/or rights of way for roads, utilities, drainage, etc. as may appear of record and/or on the premises and to any and all restrictions, covenants or zoning ordinances affecting such property as may appear of record.

TERMS OF SALE: The sale shall be for cash, and the highest bidder shall be required to make a cash deposit of five (5%) percent on the bid as earnest money and as evidence of good faith. If the Plaintiff is the successful bidder at the sale, the Plaintiff may, after paying the costs of the sale, apply the debt due upon its Judgment against its bid in lieu of cash. Should the person making the highest bid at the sale fail to comply with the terms of his bid by depositing the said five (5%) percent in cash, then the property shall be sold at the risk of such bidder on the same sales date or some subsequent date as the Special Referee may find convenient and advantageous. Should the last and highest bidder fail to comply with the terms of his bid within thirty (30) days of the final acceptance of his bid, then the selling officer shall re-advertise and resell the property on the same terms on a subsequent date at the risk of such bidder. No personal or deficiency judgment being demanded, the bidding will not remain open after the date of sale, but compliance with the bid may be made immediately. Persons submitting additional bids after the initial sale shall deposit five (5%) percent of their bids in cash as prescribed above. The Special Referee shall promptly return all deposits except the deposit securing the highest bid. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate provided by S.C. Code Ann. § 34-31-20 (B). The sale shall be subject to taxes, to existing easements and restrictions, and to homeowners association assessments accruing subsequent to the date of the deed/title issued to the purchaser. Purchaser shall pay all costs of recording the deed.
Note: If the Plaintiff or the Plaintiff’s representative does not appear at the scheduled sale of the above-referenced property, then the sale of the property will be null, void and of no force and effect. In such event, the sale will be rescheduled for the next available sales day.
Note: This sale is also made subject to all Pickens County taxes and existing easements and restrictions of record.

The Pickens County Planning Commission will meet in regular session and conduct a public hearing on Monday, July 8th, 2019, at 6:30 p.m. in the Main Conference Room at the Pickens County Administration Facility, 222 McDaniel Avenue, Pickens, SC.
Prior to the regular meeting and public hearing, the Planning Commission will meet in a worksession at 6:00 p.m. in the same location.
The Planning Commission will hold a public hearing on the following item:

LU-19-0003 Land Use approval for a Large Scale Project – Commercial/Retail (capable of generating more than 1,000 average daily vehicle trips) located at 900 Gap Hill Road/104 Store Trail, Six Mile.
