Vanderbilt Mortgage and Finance, Inc. Plaintiff, -vs-The Estate of Dian M. Garcia, by and though its Personal Representative whose name is unknown; all Unknown Heirs of Deceased Defendants, and all other persons entitled to claim under or through them being a class designated as Mary Roe; All Unknown persons with any right, title or interest in the real estate described herein, being a class designated as Jane Doe; also any Unknown persons who may be in the military service of the United States of America, being a class designated as John Doe; and Any Unknown minors, persons under a Disability or persons incarcerated, being a class designated as Richard Roe, and Christina Garcia Defendant(s)
YOU ARE HEREBY SUMMONED and required to answer the Complaint in this action, and to serve a copy of your Answer on the subscribers at their offices, 1640 St. Julian Place, Columbia, South Carolina 29202, within thirty (30) days after service hereof, exclusive of the day of such service; except that the United States of America, if named, shall have sixty (60) days to answer after the service hereof, exclusive of the day of such service; and if you fail to answer the Complaint within the time aforesaid, the Plaintiff in this action will apply to the Court for a judgment by default granting the relief demanded in the Complaint.

PLEASE TAKE NOTICE THAT an action involving real property known as 119 Ladd Lane, in which you may have an interest, has been commenced in the Court of Common Pleas for Pickens County, South Carolina and that, by Order of the Clerk of Court filed therein on , Kelley Yarborough Woody, Esquire has been appointed as the attorney to represent any unknown Defendants that may be in the military service represented by the class designated as John Doe and Guardian ad Litem Nisi for all minors and persons under legal disability as a class designated as Richard Roe, Defendants herein.
PLEASE TAKE NOTICE THAT, unless you or someone on your behalf apply to the Court for appointment of a suitable person to act as Attorney or Guardian ad Litem herein, within thirty (30) days after service by publication of this Notice, the appointment of Kelley Yarborough Woody, Esquire as Guardian ad Litem shall be made absolute.

NOTICE IS HEREBY GIVEN that an action has been commenced and is now pending in this Court upon the Complaint of the above-named Plaintiff for the foreclosure of a certain mortgage of real estate given by Dian M. Garcia to Vanderbilt Mortgage and Finance, Inc. dated March 30, 2012, and recorded in the Office of the Register of Deeds for Pickens County on April 2, 2012 at 8:24 am in Book 4441 at Page 187 The premises covered and affected by the said mortgage and the foreclosure thereof, were, at the time of making thereof and at the time of the filing of the Lis Pendens, as described on the attached Exhibit “A”.

All that certain piece, parcel or lot of land lying and being situate in the State of South Carolina, County of Pickens, located on the northern side of Ladd Road and being shown as a portion of Lot 5, containing 0.504 acre, more or less, on a survey prepared by T. Craig Keith, RLS #1712 dated June 24, 1992, and revised June 2, 1994, and having such courses, distances, metes and bounds as will be shown by reference to said plat recorded in the ROD Office for Pickens County in Plat Book 48 at Page 482. Reference is hereby made to said plat for a more complete and accurate metes and bounds description of said property.
Also; an easement and right of way over fifty foot wide road shown as “Ladd Road” leading to county road as shown on plat by T. Craig Keith, RLS #1712 dated June 24, 1992, and revised June 2, 1994. Said easement and right of way to be used by Phillip Haynie and Connie Haynie, their heirs and assigns, and Dian Garcia, her heirs and assigns, for ingress, egress, regress and utility purposes.
This being the same property conveyed to Dian Garcia by deed of Phillip Haynie and Connie Haynie as recorded in Deed Book 244 at Page 197 in the Pickens County Register of Deeds Office on 6/17/94.
