PERSONALLY appeared before me, the undersigned Notary Public for South Carolina, Perry H. Gravely, who, being duly sworn, made oath that he is the Attorney for the Plaintiff; that this is an action whereby the Plaintiff seeks a declaration from the Court that he is the lawful and fee simple owner of real property in Pickens County by virtue of Delinquent Tax Sale held October 4, 2004 and seeks an Order directing the Clerk of Court for Pickens County to execute a deed to him regarding said property; that the whereabouts of certain Defendant are unknown and that some Defendants are unknown; that due diligence and efforts have been made to locate said Defendant but to no avail; that said Defendant, known and unknown, claim or may claim an interest in the property located in the County of Pickens, State of South Carolina, said property being the subject of this action, and said property being subject to the jurisdiction of this Court; that your Deponent is informed and believes this is an action in which service may be had upon said unknown Defendant and said Defendant whose whereabouts are unknown by publication as provided by South Carolina Code Section 15-9-710.

YOU WILL PLEASE TAKE NOTICE that pursuant to an Order of the Perry H. Gravely, Special Referee for Pickens County, issued in the above captioned case, the Special Referee for Pickens County will sell at public auction to the highest bidder for cash at or before the Courthouse in Pickens, South Carolina, at 11:00 o’clock a.m., Sales Day in April, the same being April 7, 2014, the following described tract of land located in Pickens County, South Carolina:
“ALL that certain piece, parcel or lot of land lying, situate and being in the State of South Carolina, County of Pickens, in Glenwood Mill Village and being more particularly described as Lot # 157 as shown on a plat entitled, “Subdivision for Glenwood Cotton Mills, Easley, S. C.” by Pickell & Pickell Engineers and having such courses, distances, metes and bounds as will be shown by reference to said plat recorded in the Office of the Register of Deeds, Pickens County, South Carolina in Plat Book 1920 at Page 123. According to said plat, the within described lot is also known as No. 5 Garrison Street (Avenue).

This being the identical property conveyed unto Tonya M. Phillips and Michael Phillips by deed of Entrust Carolinas, LLC, TRUSTEE FBO WM. DOUGLAS TINSLEY ROTH IRA dated June 15, 2007, and recorded June 22, 2007, in Deed Book 1109 at page 106, Pickens County records.
The terms shall be for cash and the purchaser, or purchasers, shall pay for the deed and stamps. In the event the agent of Plaintiff does not appear at the time of sale, the within property shall be automatically withdrawn from sale and sold at the next available sales date upon the same terms and conditions as set forth in the Decree. Deficiency judgment having been demanded, the bidding will remain open for thirty (30) days after the date of the sale, and will re-open for upset bids on May 7, 2014. The successful bidder shall deposit with the Special Referee a certified check or cash in the amount of five (5%) percent of the bid as evidence of good faith. In the event the purchaser fails or refuses to comply with the terms of the sale within twenty (20) days from the date of sale, the deposit shall be forfeited and applied first to the costs and expenses of this action including fee for the Plaintiff’s attorney. Next, any surplus will be held pending further Order of the Court. I shall then re-advertise and re-sell the property upon the same terms on a subsequent Sales Day at the risk of the former purchaser until obtaining full compliance with a sale. The successful bidder other than the Plaintiff will pay interest on the amount of the bid from the date of sale to the date of compliance at the rate of $8.18 a day.
The sale shall be subject to taxes and assessments, to existing easements and restrictions, and to any other senior encumbrances.

YOU WILL PLEASE TAKE NOTICE that pursuant to an Order of the Perry H. Gravely, Special Referee for Pickens County, issued in the above captioned case, the Special Referee for Pickens County will sell at public auction to the highest bidder for cash at or before the Courthouse in Pickens, South Carolina, at 11:00 o’clock a.m., Sales Day in April, the same being April 7, 2014, the following described tract of land located in Pickens County, South Carolina:
