YOU WILL PLEASE TAKE NOTICE that pursuant to an Order of the Honorable Charles B. Simmons, Jr., Special Referee for Pickens County, issued in the above captioned case, the said Special Referee for Pickens County(or his designee), will sell at public auction to the highest bidder for cash at or before the Courthouse in Pickens, South Carolina, at 11:00 o’clock a.m., Sales Day in April, 2016, the same being Monday,April 4, 2016, the following described tract of land located in Pickens County, South Carolina:

ALL that certain piece, parcel or lot of land, lying and being in the State of South Carolina, County of Pickens, located off Ashton Drive and being known and designated as Lot 5, of Ashton Ridge, Phase I, as shown on survey prepared by John F. Tinsley, PLS #16824 on November 15, 1996, and having such courses, distances, metes and bounds as will be shown by reference to said plat recorded in the Office of the Register of Deeds for Pickens County in Plat Book 280 at Pages 19-20.

This being the identical property conveyed unto Kenneth John Swindle and Bonnie S. Swindle by deed of Tinsley, LLC d/b/a/ Ashton Ridge Development dated February 16, 2006, and recorded February 22, 2006, in Deed Book 981 at Page 84, Pickens County records.

The terms shall be for cash and the purchaser, or purchasers, shall pay for the deed and stamps. In the event the agent of Plaintiffs do not appear at the time of sale, the within property shall be automatically withdrawn from sale and sold at the next available sales date upon the same terms and conditions as set forth in this Decree. The bidding will not remain open after the date of sale, but compliance with the bid may be made immediately. The successful bidder shall deposit with the Special Referee a certified check or cash in the amount of five (5%) percent of the bid as evidence of good faith. In the event the purchaser fails or refuses to comply with the terms of the sale within twenty (20) days from the date of sale, the deposit shall be forfeited and applied first to the costs and expenses of this action including fee for the Plaintiff’s attorney. Next, any surplus will be held pending further Order of the Court. I shall then re-advertise and re-sell the property upon the same terms on a subsequent Sales Day at the risk of the former purchaser until obtaining full compliance with a sale.

The sale shall be subject to taxes and assessments, to existing

easements and restrictions, and to any other senior encumbrances, including first mortgage covering this property herein given by Kenneth John Swindle and Bonnie S. Swindle to “MERS”/First Franklin, a division of Nat. City Bank of IN, dated February 16, 2006, and recorded February 22, 2006, in Mortgage Book 3192 at Page 276, Pickens County records, in the amount of $73,500. The approximate balance due on said first mortgage is $64,875.22.

BY VIRTUE of a decree heretofore granted in the case of FIRST-CITIZENS BANK & TRUST COMPANY, INC. f/k/a FIRST CITIZENS BANK AND TRUST COMPANY, INC. against REBECCA K. HOOPER, I, the Special Referee for Pickens County, will sell on Monday, March 7, 2016, at 11:00 a.m., at the Pickens County Courthouse, 214 East Main Street, Pickens, SC, to the highest bidder:

All that certain piece, parcel or lot of land situate, lying and being in the State of South Carolina, County of Pickens, containing 1.92 acres, more or less, as shown and more fully described on a plat thereof prepared by Lindsey & Associates, Inc., Surveyors, entitled “Survey for James J. TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Special Referee at conclusion of the bidding, five percent (5%) of the bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to Plaintiff’s debt in the case of non-compliance. If the Plaintiff’s representative is not in attendance at the scheduled time of the sale, the sale shall be canceled and the property sold on some subsequent sales day after due advertisement. Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee may re-sell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder).

As a deficiency judgment is not being waived, the bidding will remain open thirty (30) days after the date of sale.

Purchaser to pay for preparation of deed, documentary stamps on the deed, and recording of the deed. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate of 4.74% per annum.
