NEAL LANE PROPERTIES, LLC, Plaintiff, vs. CASS CASTO and SOUTH CAROLINA DEPARTMENT OF REVENUE, Defendants.

Pursuant to Court Decree in Neal Lane Properties, LLC vs. Cass Casto and South Carolina Department of Revenue, I will sell at public auction to highest bidder at Pickens County Courthouse on August 03, 2015 at 11:00 a.m. o’clock the following property:

a. Legal Description

“All that certain piece, parcel or lot of land lying and being situate in the State of South Carolina, County of Pickens, and being known and designated as Lot 39 in the Woodside Mill Subdivision as shown on plat of Robert R. Spearman, Reg. L. S. No. 3615, dated September 13, 1982, reference to which is hereby made for a more complete and accurate description, and being thereon more fully described according to said plat as follows, to-wit:

“BEGINNING at a point on Second Street, which point is into asphalt drive dividing Lot No. 40 and Lot No. 39; thence running along Second Street S28-04E 57.21 feet to a point on edge of street; thence S15-53W 35.46 feet to a point on Second Street; thence continuing along Second Street S62-26W 83.54 feet to a point in center of 12’ alley; thence running along center of alley N31-00W 76.50 feet to a point in center of alley; thence leaving alley and running along property of Lot No. 40 in a northeasterly direction N58-04E 112.20 feet to the point of BEGINNING, and being bounded on the northeast, east, and southeast by Second Street; bounded on the southwest by the 12’ alley; and bounded on the northwest by Lot No. 40.”

THIS BEING THE SAME PROPERTY conveyed to Cass Castro by deed from Neal Lane Properties, LLC by deed dated October 3, 2007, and recorded in the Register of Deeds Office for Pickens County on October 9, 2007 in Book 1140 at Page 43.

The total judgment debt set forth in the Order is: $37,075.46

The property will be sold subject to any past due or accruing property taxes, assessments, existing easements and restrictions of record and any other senior encumbrances.

The successful bidder must pay interim interest from the date of sale through date of compliance at a rate of 10.00%.

Each successful bidder other than Plaintiff at time bid is accepted will be required to deposit with Special Referee as evidence of good faith 5% if bid in cash or certified check at the time of bid. In event purchaser fails or refuses to comply with terms of sale within 20 days from close of bidding, deposit shall be forfeited and applied to costs and then Plaintiff’s debt, and the Special Referee shall forthwith re-advertise and resell said property upon the same terms on some subsequent sales day at the risk of the former purchaser until obtaining full compliance with sale.

Bidding will close on sales day.

Terms of sale: Purchaser to pay deed preparation and deed stamps.

NOTICE IS HEREBY GIVEN that an action has been commenced in the Court upon amended complaint of the above-named plaintiff against the above-named defendants to foreclose on a mortgage on the property described below. The premises covered and affected by the said mortgage were, at the time of the making thereof, and at the time of the filing of this Notice, described as follows:

PARCEL A

ALL those certain pieces, parcels or tracts of land, containing 112.28 acres, more or less, with all improvements thereon, situate, lying and being on the northern side of South Carolina Highway No. 11 and U. S. Highway No. 178, in the County of Pickens, State of South Carolina, being shown and designated as Tracts 1, 2, 3, and 4 on Plat of Survey for Gauley Falls Golf Course, Inc., prepared by C. E. Shehan Surveying, dated February 9, 1995 and recorded in the Office of the Register of Deeds for Pickens County, South Carolina in Plat Book 216 at Page 13, reference being hereby made to said plat of survey for a complete metes and bounds description of the property.

LESS AND EXCEPT:

THAT certain piece, parcel or tract of land containing 0.09 acres, more or less, conveyed by Water Head, LLC to the South Carolina Department of Transportation by deed dated April 13, 2005 and recorded in the Office of the Register of Deeds for Pickens County, South Carolina, on May 12, 2005 in Deed Book 903 at Page 286.

LESS AND EXCEPT:

THAT certain piece, parcel or lot of land, with all improvements thereon, situate, lying and being on the southern side of Hambys Way in the County of Pickens, State of South Carolina, being shown and designated as a 1.77 acre parcel on a plat of survey entitled “Survey for Waterhead, LLC”, prepared by Ray Dunn Land Surveyor, dated February 2, 2005 and recorded in the Office of the Register of Deeds for Pickens County, South Carolina, on March 3, 2005 in Plat Book 60 at Page 554, reference being hereby made to said plat of survey for a complete metes and bounds description of the property.

ALL those certain pieces, parcels or lots of land being shown and designated as a 0.03 acre portion of Lot 8 of Gauley Falls subdivision and a 0.48 acre portion of Lot 8 of Gauley Falls subdivision on a plat of a revision of Lot 8 of Gauley Falls subdivision, prepared by C. E. Shehan Surveyors, dated October 7, 2004 and recorded in the Office of the Register of Deeds for Pickens County, South Carolina on January 28, 2005 in Plat Book 518 at Page 14B, reference being hereby made to said plat for a complete metes and bounds description of the property.

LESS AND EXCEPT

THAT certain piece, parcel or lot of land situate, lying and being in the County of Pickens, State of South Carolina, being shown and designated as a 0.12 parcel forming a part of revised Lot 8 of Gauley Falls subdivision, Section 1, as shown on a plat of survey of a revision of Lot 8 of Gauley Falls Subdivision, Section 1 prepared by C. E. Shehan Surveying, dated October 7, 2004 and recorded in the Office of the Register of Deeds for Pickens County, South Carolina on January 28, 2005 in Plat Book 518 at Page 14B, reference being hereby made to said plat for a complete metes and bounds description of the property.

By virtue of a decree of the Special Referee for Pickens County, heretofore granted in the case of Luthi Mortgage Company, Inc. against Oder L. Breedlove and Sandra K. Breedlove, et al., I, the undersigned Special Referee or designee of Court for Pickens County, will sell on August 3, 2015, at eleven o’clock a.m. at the Pickens County Courthouse, Pickens, South Carolina to the highest bidder:

ALL that certain piece, parcel or lot of land situate, lying and being in the State of South Carolina, County of Pickens, located approximately 5 miles northeast of Pickens, South Carolina, and according to a plat made by Thomas C. Keith Reg.
