BY VIRTUE of a decree heretofore granted in the case of Provident Funding Associates, L.P. against Lindsay Ann Koenig, I, the Special Referee for Pickens County, will sell on Monday, October 3, 2022, at 11:00 o’clock a.m., at the Pickens County Courthouse, Pickens, South Carolina, to the highest bidder:
All that certain piece, parcel or lot of land situate, lying and being in the State of South Carolina, County of Pickens, in Hurricane Township, being shown and designated as Lot 3 on a survey entitled “Survey for McShire Associates, Inc.,” dated 04/10/2008, prepared by Stephen R. Edwards & Associates, Inc., and recorded in the ROD Office for Pickens County, SC in Plat Book 600 at Page 82. Reference to said plat is hereby made for a more complete metes and bounds description thereof.
This being a portion of property conveyed to Sterling Custom Homes, LLC by deed from McShire Associates, LLC, dated 04/02/14 and recorded 04/07/14 in the Register of Deeds Office for Pickens County, SC in Deed Book 1595, at Page 155.
LESS HOWEVER: All that certain piece, parcel or lot of land situate, lying and being in the State of South Carolina, County of Pickens, in Hurricane Township, being shown and designated as Pt Lot 3 on a survey entitled “Survey for Anna L. Gravely,” dated 7/27/2015, prepared by Jay Dunn Land Surveyor, PLS #24276, and recorded in the Register of Deeds Office for Pickens County, SC, in Plat Book 602 at Page 129. Reference to said plat is hereby made for a more complete metes and bounds description thereof.
This is the same property conveyed unto Lindsay Ann Koenig by deed from Sterling Custom Homes, LLC dated 10/19/16 and recorded on 10/20/16 in the Register of Deeds Office for Pickens County, South Carolina in Deed Book 1809 at Page 300.
The above-described property is subject to any and all easements and/or rights of way for roads, utilities, drainage, etc. as may appear of record and/or on the premises and to any and all restrictions, covenants or zoning ordinances affecting such property as may appear of record.

TERMS OF SALE: The successful bidder, other than the plaintiff, will deposit with the Special Referee for Pickens County at conclusion of the bidding, five percent (5%) of the bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to plaintiff’s debt in the case of non-compliance. If the Plaintiff’s representative is not in attendance at the scheduled time of the sale, the sale shall be canceled and the property sold on some subsequent sales day after due advertisement. Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, the deposit shall be forfeited and the Special Referee for Pickens County may re-sell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder). As a deficiency judgment is being Waived, the bidding will not remain open thirty days after the date of sale. Purchaser shall pay for preparation of deed, documentary stamps on the deed, and recording of the deed. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate of 3.750% per annum. The sale shall be subject to assessments, Pickens County taxes, easements, easements and restrictions of record, and other senior encumbrances.
